FIRST SALE DECLARATION August 26, 2008 Effective for a one-year period beginning August 20, 2008, all importers will be required to provide a declaration to CBP at the time of filing a consumption entry when, in a series of sequential sales, the transaction value of the imported merchandise is determined on the basis of the ``first or earlier sale''. This is sometimes referred to as a “multi tiered transaction”. CBP will then report the frequency of the use of the ``first sale'' rule and other associated data to the International Trade Commission
(ITC) on a monthly basis.
All importers are requested to specifically notify us of which, if any transactions are based on “first sale” valuation. We can then make the correct declaration on the importers behalf.
Note: Even though the effective date is 8-20-08, CBP has granted a 30 day extension to allow for programming but have stated entries filed on/after 8-20-08 will need to be amended.
