During the May 9, 2008 meeting of the Departmental Advisory Committee on Commercial Operations of the U.S. Customs and Border Protection and Related Homeland Security Functions (COAC), CBP officials discussed a variety of issues related to CBP's proposed rule to require Security Filing (SF) information from importers and additional information from carriers (10+2) for vessel (maritime) cargo before it is brought into the U.S.

CBP Has Completed its Review of Comments on Proposed Rule

CBP officials stated that CBP has completed its review of the comments it received on its proposed rule and its Office of Rulings and Regulations has prepared responses to the comments received.

200 formal comments were received in response to its proposed rule. The main topics discussed in the comments include:

• receipt and acknowledgement of the SF
• responsible parties
• implementation
• continued outreach
• harmonization with the World Customs Organization (WCO) framework
• penalties and liquidated damages
• business changes
• bonding issues
• technical requirements

CBP to Begin Discussing Data Layouts with the Trade

CBP officials stated that CBP would soon begin to discuss the data layouts for 10+2 with the trade community.

CBP Remains Committed to Phased Implementation

CBP officials confirmed that CBP remains committed to a phased implementation of its 10+2 final rule.
